Indonesia Financial Services Authority Regulation No. 61/POJK.07/2020 concerning Alternative Institutions for Financial Services Sector Dispute Resolution

Based on the Article 10 of Indonesia Financial Services Authority Regulation No. 61/POJK.07/2020 concerning Alternative Institutions for Financial Services Sector Dispute Resolution, which commonly abbreviated as LAPS-SJK, the LAPS-SJK is required to periodically evaluate the LAPS-SJK regulations. In the light of this, Tumbuan and Partners on behalf of AMVESINDO had the opportunity to attend the Focus Group Discussion (FGD) held by LAPS-SJK on November 12, 2022, at Ashley Hotel Wahid Hasyim. LAPS-SJK deems the significance to hold a FGD with the Association/Members of SRO-Founder of the LAPS-SJK to conduct discussions on evaluating the LAPS-SJK regulations to produce an accurate law based on the common practice and harmonization with Arbitration regulations in Indonesia. The FGD mainly discussed the LAPS-SJK Regulation on the following aspects, namely: (i) Mediation; (ii) Arbitration; (iii) Mediator and Arbitrators; (iv) Fee Regulations; and (v) Online Dispute Resolution. The FGD was narrated by Joni Emirzon (Professor of business law FH UNSRI, BANI Arbitrator, LAPS-SJK ‘s Mediator and Arbitrator), Fahmi Shahab (Executive Director of the National Mediation Center (PMN) – LAPS-SJK’s  Mediator ), and Tri Legono Yanuarachmadi (LAPS-SJK’s  Secretary).
