The Indonesian People’s Representative Council and Government of the Republic of Indonesia has recently enacted the long-awaited Personal Data Protection Bill into law, providing a new overarching framework for personal data protection in Indonesia through Law No. 27 of 2022 concerning Data Protection (PDP Law).

The PDP Law introduces significant developments in the regulatory framework regarding personal data protection in Indonesia. While the changes are many and varied, in many aspects of Data Protection in Indonesia, including the (i) types of personal data; (ii) lawful basis for processing of personal data; (iii) rights of data subjects; (iv) data controller and data processor; (v) data protection officer; (vi) enforcement and other aspects.

The PDP Law is more closely aligned with international data privacy standards, which largely modelled on the European Union’s General Data Protection Regulation, the “gold standard” for Personal Data protection worldwide and it goes further by introducing criminal sanctions for certain personal data breaches. In this way, the government is sending a strong message to both individuals and corporations that personal data protection is now a highly regulated sector in Indonesia.
